Summary:A completely new approach started with the case of the spy George Blake: today restitutionary damages have become an interesting, unusual, and controversial type of remedy in the area of copyright law. The decision of the Attorney General v. Blake is quite specific. It makes us consider the importance of both the moral rights of the author and the moral value of his work. Although the common law measure of damages is ordinarily designed to compensate the claimant for suffered loss, in the case of the famous double agent we can find a new exception, perhaps controversial, to this rule in copyright law. One can agree with those who think that this decision is „one of the most wrong cases" but one cannot dispute the fact that restitutionary damages are an existing category in copyright law.
