Description
Summary:Journalistic data processing has come a long way in the past quarter century. It helped shape democracy and was characterized by overlapping fi elds of law, disputes at court and an insatiable appetite for the freedom of information. Besides the courts addressing the problems concerning the confl icting interests of journalists and public fi gures defending their own personality rights and interests, the data protection authority has also taken an active role in examining the lawfulness of journalistic data processing operations in the recent years. The new European General Data Protection Regulation (GDPR) applicable as of 25 May 2018 further changed the way we think about data and how the press and media enterprises can access and publish often sensitive pieces of information. With regard to the above, this study summarizes the previous and the current Hungarian and European legal provisions concerning journalistic data processing and the freedom of information, as well as the relevant court and data protection authority practice in these fi elds. Besides the above, the study also assesses the relations between data protection law, personality rights and the rules concerning the freedom of information and outlines the main challenges of journalistic data processing in the upcoming years.
