|a Amíg a legklasszikusabb iparjogvédelmi oltalmak, mint a szabadalom a műszaki megoldást, a belsőt védi, addig a formatervezési minta a külsőt, a megjelenést, a műszaki megoldás úgynevezett csomagolását oltalmazza. Az Európai Unió a formatervezési minták területén kettő új instrumentummal frissíti a szabályozást: megújul a formatervezési mintákra vonatkozó irányelv és a rendelet is. A tanulmány részletesen foglalkozik a gyakorlatban megjelent problémák közül a minták módosíthatóságával és az oltalom alóli kivételekkel, többek között a pótalkatrészek problémakörével. Arra is megkísérel válaszokat keresni, hogy mennyiben veszélyezteti a forgalom biztonságát a lajstromban nem látható mintaoltalmat léte. A rendelkezésre álló normaszövegek és az előzményesetek segítségével próbál a tanulmány választ adni a potenciális jogalkalmazási kérdésekre.

|a While the most classical industrial property rights, such as patents, protect the technical solution, the inside, a design protects the appearance, the so-called packaging of the technical solution. The European Union is updating its legislation in the field of designs with two new instruments: the new Design Directive and the Regulation proposals. The study deals in detail with the problems encountered in practice, such as the modifiability of designs and exceptions to protection, including the problem of spare parts. It also attempts to answer the question of the extent to which the safety of circulation is jeopardised by the existence of design protection which is not visible in the relevant register. Using the available normative texts and the preceding cases, the study attempts to provide answers to potential enforcement issues.
